1. Application
These terms and conditions of trade (hereinafter "the terms") apply to all products sold on www.dragostore.dk (hereinafter "the website" or "site(s)") by Drago (hereinafter "the company"), which users thereof (hereinafter "users") may purchase. Furthermore, Drago is also referred to as "We".
By placing an order for digital or physical products with DRAGO, you accept DRAGO's Terms and Conditions of purchase, as outlined below.
2. Products
The products sold from the website depend on the user's choice. This applies to product, product variant, etc. For the correct products to be delivered, it is of course essential that the customer chooses the correct products. In case of incorrect purchases, the customer is always welcome to contact the company in one of the following ways: email, social media (e.g., Instagram), or our website's live chat function. This should be done as soon as possible.
If an order needs to be canceled, this must be done before the item's delivery process has begun, i.e., before it leaves Drago. We ship packages continuously every day of the week. Therefore, please notify us as soon as possible, either on Instagram, through the live chat function on our site, or via email, about this.
2.2 Gift Card Terms

Validity:
Gift cards issued by DRAGO are valid for 12 months from the date of issue, unless otherwise specified. The expiry date is clearly stated on the gift card. -
Usage:
Gift cards can only be used as payment for purchases on our webshop www.dragostore.dk. The gift card is redeemed by entering the unique code at checkout. -
Partial use and balance:
If a purchase is made for an amount lower than the gift card's value, the remaining balance will remain valid within the gift card's validity period. It is not possible to cash out the remaining balance. -
Exchange and refund:
Gift cards cannot be exchanged for cash, neither wholly nor partially. Lost or stolen gift cards will not be replaced. -
Combination with discount codes:
Unless otherwise stated, gift cards cannot be combined with other discounts, promotions, or discount codes. -
Right of withdrawal:
When purchasing gift cards online, there is a 14-day right of withdrawal, provided the gift card has not been used. If you wish to exercise your right of withdrawal, please contact us at lucas@dragostore.dk.
3. Price and Payment
All prices on the website www.dragostore.dk are in Danish Kroner (DKK) and include VAT for all products. When you complete a purchase on the website, the amount will be charged to your payment card as soon as possible, usually on the same day.
The website accepts payments from, among others, Mobilepay, Google Pay, Apple Pay, Klarna, Trustly, Anyday Visa/Dankort, and Mastercard. The company pays the fee charged by the payment acquirer (those who facilitate payment via these payment methods). The user is responsible for any other fees that their own card issuer may charge.
When paying with Visa, Mastercard, Visa Electron, Mobilepay, etc., the amount is reserved on the associated account until the payment is made. The payment is only collected by DRAGO once the order is confirmed and sent for packing.
3.1 Klarna
Klarna: In order to offer Klarna's payment solutions, we transmit your personal data in the form of contact and order details to Klarna in our ordering process, so that Klarna can assess whether you meet the requirements for their payment solutions, and tailor the payment solutions to you. The personal data we transmit to Klarna is in accordance with Klarna's own privacy policy klarna.com
Klarna Pay Later: The invoice amount is due within 30 days of the goods being dispatched and the invoice being received.
3.2 Anyday
Anyday: Anyday is an installment payment solution where you can pay for your products in several installments, which will be automatically charged to your card after you have signed up for Anyday. The first installment will be charged directly at the time of purchase. If all installments are paid on time, no further interest or fees will be added beyond the product's value. 3.3 Trustly
Trustly: Trustly is a platform that allows easy and secure transactions for you as a consumer. When you use Trustly, you accept their Terms of Service, which you can find here.
4. Delivery
The customer's order will be delivered according to the customer's choice, which is determined during the payment process on the website. This could, for example, be delivery to a parcel shop. The delivery price is determined by Drago and approved by the customer during purchase. Customers can expect to receive their item, or have it ready for pickup, within 1-3 business days (under normal circumstances).
4.1 Express Delivery
With express delivery, your goods will be delivered within 1-3 business days, provided that the order is received in DRAGO's systems before 2:00 PM on the day you placed the order.
If you order your goods on a European public holiday, your package may be delivered 2 business days later than the 1-3 business days.

5. Data Processing
Drago will never forward your private information. With the customer's explicit consent, for example by subscribing to our mailing list / newsletter, this information will be used for direct communication with the customer, but exclusively by Drago and Drago's employees, and solely on behalf of Drago.
6. Changes
The company can unilaterally change the terms and conditions.
7. Law and Jurisdiction
Danish law applies to users' purchases on the website. In the event of a dispute, the case must typically be brought before the District Court of the municipality where the company is located. Currently, this is Ballerup Municipality.
Extra: In addition, general terms and conditions for purchases under Danish law apply, including general right of complaint.
8. Mobile Terms of Service (TOS)

The Drago mobile message service (the "Service") is operated by Drago (“Drago”, “we”, or “us”). Your use of the Service constitutes your agreement to these terms and conditions (“Mobile Terms”). We may modify or cancel the Service or any of its features without notice. To the extent permitted by applicable law, we may also modify these Mobile Terms at any time and your continued use of the Service following the effective date of any such changes shall constitute your acceptance of such changes.
By consenting to Drago’s SMS/text messaging service, you agree to receive recurring SMS/text messages from and on behalf of Drago through your wireless provider to the mobile number you provided, even if your mobile number is registered on any state or federal Do Not Call list. Text messages may be sent using an automatic telephone dialing system or other technology. Service-related messages may include updates, alerts, and information (e.g., order updates, account alerts, etc.). Promotional messages may include promotions, specials, and other marketing offers (e.g., cart reminders).
You understand that you do not have to sign up for this program in order to make any purchases, and your consent is not a condition of any purchase with Drago. Your participation in this program is completely voluntary.
We do not charge for the Service, but you are responsible for all charges and fees associated with text messaging imposed by your wireless provider. Message frequency varies. Message and data rates may apply. Check your mobile plan and contact your wireless provider for details. You are solely responsible for all charges related to SMS/text messages, including charges from your wireless provider.
You may opt-out of the Service at any time. Text the single keyword command STOP to Drago or click the unsubscribe link (where available) in any text message to cancel. You'll receive a one-time opt-out confirmation text message. No further messages will be sent to your mobile device, unless initiated by you. If you have subscribed to other Drago mobile message programs and wish to cancel, except where applicable law requires otherwise, you will need to opt out separately from those programs by following the instructions provided in their respective mobile terms.

We may change any short code or telephone number we use to operate the Service at any time and will notify you of these changes. You acknowledge that any messages, including any STOP or HELP requests, you send to a short code or telephone number we have changed may not be received and we will not be responsible for honoring requests made in such messages.
The wireless carriers supported by the Service are not liable for delayed or undelivered messages. You agree to provide us with a valid mobile number. If you get a new mobile number, you will need to sign up for the program with your new number.
To the extent permitted by applicable law, you agree that we will not be liable for failed, delayed, or misdirected delivery of any information sent through the Service, any errors in such information, and/or any action you may or may not take in reliance on the information or Service.

Right of Withdrawal
You have an extended 60-day right of withdrawal. The 60 days apply from the date your item(s) are received. Example: If you receive your package on the 1st day of the month, your right of withdrawal expires exactly 60 days later. We must receive confirmation that the item has been sent back to us before the withdrawal date has passed. The right of withdrawal applies to items that have not been used. Therefore, we cannot accept products that show signs of use or other degradation of integrity.
We will refund the money to the payment card you used for the original purchase. The money will be returned to the customer once the item has been received by us, inspected, and most importantly, approved in accordance with our return requirements. We do not reimburse return shipping or the original shipping cost of the initial order.
Return Requirements
For us to approve a return, the item must be returned in its original condition so that the product can be resold. This includes that the item has not been used, washed, and is in the same condition as the customer received the product, which should also be the same condition as when it left DRAGO. In addition, it must be returned in its original packaging.
Items exempt from the right of withdrawal
For reasons of health protection and hygiene, the following products cannot be returned if the seal is broken or the packaging opened after delivery:
Socks
Underwear
Water bottles and other products intended for liquid intake
Personal care products
These products are exempt from the right of withdrawal in accordance with section 20, subsection 1, no. 5 of the Danish Consumer Contracts Act. Returns are only accepted if the item is returned in unused condition and in unbroken, original packaging.
Invalid returns and costs
If you return an item that does not meet the conditions for withdrawal, we reserve the right to reject the return and send the item back to you. In such cases:
- As the customer, you cover the shipping costs for the return. This will never cost more than our general shipping cost, which you used during the original confirmation of your order.
- The shipping amount will be deducted from any refund or charged separately if there is no refund claim.
- We will always contact you before sending the item back.
We recommend that you carefully read our terms and contact us if in doubt before returning products that may be exempt.
Return Shipping
DRAGO offers an extended 60-day return policy. This means you can return/exchange products from your order within 60 days of receiving it. The customer pays for the return shipping. You simply need to use the link found under returns on our product pages.
For partial returns of an order, the shipping amount for the original order will not be refunded. For a complete return of an order, the shipping amount from the original order will be refunded. If the shipping amount is refunded, the refunded amount will be equal to the cheapest standard form of delivery.

Exchange
Drago offers product exchanges during the return period. For an item to be exchanged for a different size/product, the same requirements as for product returns must be met (see return requirements above).
When exchanging, the customer covers the return shipping cost for the item being exchanged. DRAGO covers the shipping cost for the exchanged (new) product.

Complaints
When you shop with us as a consumer, you have a 24-month right to complain in accordance with the Sale of Goods Act. This means that you can either have the item repaired, exchanged, your money back, or a reduction in price, depending on the specific situation.
The right to complain covers defects and deficiencies that were present at the time of delivery. Damages caused by improper use, lack of maintenance, or ordinary wear and tear are not covered by the right to complain.
If you wish to complain about an item, please contact us as soon as possible after discovering the defect. You must complain within a reasonable time after the defect has been discovered. Complaints made within two months of discovering the defect are always considered timely.

When returning an item in connection with a complaint, please include a description of the defect and your order confirmation or other documentation of the purchase.
If the complaint is justified, we will refund your reasonable shipping costs. Remember to send the item in secure packaging and obtain a receipt for dispatch so that we can reimburse your shipping costs.

Fees for complaint processing
To submit a complaint, you must pay a fee, which is determined by Nævnenes Hus.
For complaints to the Consumer Complaints Board, you must pay a complaint fee of DKK 400, which the Consumer Complaints Board will refund if you win the case. Read more here.
